Civil Bill for Possession
This is the document used to apply for a Repossession Order in the Circuit Court by your mortgage lender. You will receive the Civil Bill for Possession at least 21 days before your court hearing.
On the Civil Bill you will be known as the defendant and the mortgage lender will be known as the Plaintiff.
The Civil Bill you received includes the following information:
- The title of your case/case record number.
- The date your case will be heard in court ('the return date'). It is essential that you note carefully the date and time for your case. You need to attend court on this date.
- The Circuit and County where the mortgage lender is submitting your claim.
- The mortgage lender's name, address and email as well as their solicitors' details.
- Information on responding to the Civil Bill for Possession. For more information please see responding to a Civil Bill for Possession.
- Details of the case being made against you - this can be found in the 'Special Indorsements' section of the Civil Bill for Possession. It will also set out the order that the mortgage lender wants the court to make.
Other documents you will receive
You will receive a number of other court documents with your Civil Bill for Possession including:
- An Affidavit (a sworn statement setting out the facts and relevant documents as part of a case) from the mortgage lender. This will be attached to the Civil Bill for Possession. This includes documents and evidence to be used in the case being made against you.
- A blank Appearance form (Entry of Appearance form (Form 5)). This form must be completed to let the court know that you have received the Civil Bill and are acknowledging it. For more information, please see how to complete your Entry of Appearance form.
How you will receive these documents
You will receive this document by registered post or else it will be handed to you by a Summons Server (A person who specialises in serving legal documents, and who will charge a fee for this service.)
