How this form is used
This form is a sworn statement about the welfare and arrangements for any dependent children of the family. It is usually filed with your divorce or judicial separation application in the Circuit Family Court. Use this form when applying for a divorce.
When to use this form
- Use this form if there are dependent children of the family (generally under 18, or over 18 and in full-time education).
- If there are no dependent children, this form is normally not required.
Who completes it
- The applicant usually files a Form 37B.
- The respondent may also file one. If the respondent agrees with the applicant’s affidavit of welfare, they may swear an affidavit confirming agreement instead of completing a new Schedule.
Before you start
- Children’s full names and dates of birth.
- Addresses where the children live and who lives with them.
- School/college/training details and any special educational needs.
- Day-to-day care and childcare arrangements; parents’ work commitments.
- Maintenance arrangements (agreed or ordered) and any applications planned.
- Contact/overnights/holiday arrangements with each parent.
- Health information (any serious disabilities, chronic illnesses, or special care needs).
- Any existing court orders or care/supervision involvement (attach copies if available).
