Affidavit

You or your solicitor will need to complete an affidavit to support your application. An Affidavit is a written statement which is sworn to be true by the person signing it.

You will need to include the following information to complete your affidavit:

  • District Court number and area. Please see our map, this can be found here.
  • A record number which will be inserted by the court office,
  • Enter the enactment which is the section of the legislation that is relevant to your application -
  • In the first paragraph explaining briefly why you are entitled to swear this affidavit.
  • Add your remaining evidence in numbered paragraphs setting out in simple, factual language.
  • What order or decision you rely on
  • What has happened or not happened
  • Any key dates, amounts and facts that are important

The remaining section will be completed by the commissioner for oaths or practising solicitor. You will sign the affidavit and swear the information is true in front of them.

Stamp fee

You must pay a €15 court fee for the affidavit. The fee can be paid at your local court office or if you are based in Dublin, at the Stamping Office in the Áras Uí Dhálaigh building in the Four Courts complex. You can pay these fees by card or cash. 

Swearing an affidavit

When your affidavit is filled in and stamped, you should go to an independent Commissioner for Oaths or practising solicitor who will verify the affidavit. Before you swear the oath, they will check that you have read the affidavit and fully understand its contents.
